Tamper Resistant Prescription Pads

Beginning October 1, 2007 (extended to April 1, 2008), prescriptions for Medicaid outpatient drugs that are written and non-electronic must be written on tamper resistant prescription pads.  This requirement does not apply to refills of written prescriptions presented at a pharmacy prior to October 1, 2007.  Emergency fills of non-controlled and controlled drugs (to the extent permissible under federal and state laws and/or regulations) are allowed provided that the prescriber submits a verbal, faxed, electronic or compliant written prescription within 72 hours.  CMS (Center for Medicaid and Medicare Services) has outlined the three baseline characteristics of a tamper resistant prescription pad as follows:

1) one or more industry-recognized features designed to prevent unauthorized copying of a completed or blank prescription form;

2) one or more industry-recognized features designed to prevent the erasure or modification of information written on the prescription by the prescriber;

3) one or more industry-recognized features designed to prevent the use of counterfeit prescription forms.

By October 1, 2007 (extended to April 1, 2008), each state must define at least one of the above as a requirement to meet the minimum standard to be considered tamper-resistant. By October 1, 2008, states must require all three characteristics. The requirement does not apply in the following situations:

1) when the prescription is communicated by the prescriber to the pharmacy electronically, verbally or by fax

2) when the payer is a managed care organization (MCO)

3) when drugs are provided in certain institutional and clinical facilities(e.g. nursing facilities, intermediate care facilities for the mentally retarded, etc.)
